Description of Services and Acceptance of Terms of Use

Welcome to the mobile application Jammed ReStore (the “App”), operated by Jammed ReStore (“we” or “us”). The services provided on the App include facilitating the buying and selling of pre-owned goods, fostering a sustainable and eco-conscious community, and any other features, content, or applications offered from time to time by Jammed ReStore in connection with the App (collectively the “Services”). By visiting the App and/or any resulting website or using the Services, whether as a guest or a registered user, you accept and agree to these Terms, including any future modifications, and to abide by all applicable laws, rules, and regulations.

Please read through this agreement, as well as the Privacy Policy, carefully. All information collected by Jammed ReStore on or through the App is subject to our Privacy Policy. By visiting the App or using the Services, you consent to all actions taken by Jammed ReStore with respect to your information in compliance with the Privacy Policy.

Jammed ReStore may modify these Terms from time to time, at its sole discretion. Any changes are effective upon posting on the App or website. Your continued use of the App or the Services following any such modification constitutes your acceptance and agreement to the Terms as modified.

Jammed ReStore reserves the right to change or cease offering the App or any part, portion, or functionality without notice. Jammed ReStore will not be liable if for any reason all or any part of the App is not available at any time. By using our Services, you acknowledge that you have read and understood our Privacy Policy and Terms of Service and accept our collection, use, and disclosure of your information and data, and other activities, as described below.

Intellectual Property Rights

Jammed ReStore and its contents, features, and functionality (including, but not limited to, software, text, images, audio, videos, and the design, selection, and arrangement of the same) (collectively the “Content”) are owned by Jammed ReStore, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The names and logos of Jammed ReStore, all related names, logos, product and service names, designs, and slogans are trademarks and/or copyrights of Jammed ReStore. All other names, logos, product and service names, designs, and slogans on Jammed ReStore are the trademarks of their respective owners.

Except as expressly set forth in these Terms or otherwise expressly granted to you in writing by Jammed ReStore, no rights (either by implication, estoppel, or otherwise) in or to the Content are granted to you. All rights not expressly granted to you are reserved by Jammed ReStore.

Permitted Use

Jammed ReStore allows you to use the App in accordance with these Terms for your personal, non-commercial use. Except as provided in these Terms, you may not copy, download, stream, capture, reproduce, duplicate, archive, upload, modify, translate, publish, broadcast, transmit, retransmit, distribute, perform, display, sell, or otherwise use any Content appearing on the App.

Subject to your strict compliance with these Terms, you may:

• Use the Jammed ReStore Services to browse, list, buy, or sell pre-owned goods for personal use, in accordance with its predefined functionality; • Participate in community features, such as reviews, ratings, or in-app messaging, where available.

You will not:

• Use Jammed ReStore in any way that violates any regional, federal, state, local, or international law or regulation;

• Violate the rights of others including patent, trademark, copyright, privacy, publicity, or other proprietary rights;

• Post, upload, or otherwise transmit or link to any content that is unlawful, harmful, abusive, hateful, discriminatory, obscene, vulgar, harassing, excessively violent, defamatory, false, or misleading;

• Harass or harm another person;

• Exploit or endanger a minor;

• Impersonate or attempt to impersonate any person or entity;

• Disable, overburden, damage, or impair Jammed ReStore or interfere with another’s use;

• Introduce any virus, Trojan horse, worm, logic bomb, or other material which is malicious or technologically harmful;

• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of Jammed ReStore or any server, computer, or database connected to the App;

• Attack Jammed ReStore via a denial-of-service attack or a distributed denial-of-service attack;

• Engage in any other conduct which, as determined by Jammed ReStore, may harm the company or users of the App or expose them to liability; • Otherwise attempt to interfere with the proper working of Jammed ReStore; or

• Facilitate or encourage others to do any of the foregoing acts.

Your Reliance on Information

The information presented on or through Jammed ReStore is made available solely for general informational purposes. Jammed ReStore does not warrant the accuracy, completeness, or usefulness of any of this information. Any reliance you place on such information is strictly at your own risk.

The Services may contain links to other sites and resources provided by third parties. These links and resources are provided for your convenience only. Jammed ReStore has no control over the contents of those sites or resources and accepts no responsibility for them or for any loss or damage that may arise from your use of them. When you use such links and resources, you do so at your own risk and subject to the terms and conditions of use for such websites. The inclusion of any link does not imply approval or endorsement by Jammed ReStore of the service provided by the third party.

Disclaimer of Warranties

YOUR USE OF JAMMED RESTORE, ITS CONTENT, AND ANY FUNCTIONALITY, SERVICES, OR ITEMS OBTAINED THROUGH THE APP IS AT YOUR OWN RISK. ALL SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. JAMMED RESTORE HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE.

Limitation on Liability

IN NO EVENT WILL JAMMED RESTORE, ITS LICENSORS, SERVICE PROVIDERS, OR ANY OF THEIR EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF JAMMED RESTORE OR ANY SERVICES OBTAINED THROUGH THE APP, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Indemnification

You agree to defend, indemnify, and hold harmless Jammed ReStore, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, and agents from any claims, liabilities, damages, or expenses arising from your violation of these Terms or your use of the App.

Governing Law and Jurisdiction

All matters relating to Jammed ReStore and these Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana. Any legal suit, action, or proceeding shall be instituted exclusively in the courts located in Accra, Ghana.

Waiver and Severability

Jammed ReStore may only waive its rights under these Terms in writing. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms and our Privacy Policy constitute the sole and entire agreement between you and Jammed ReStore with respect to the App.
